Welcome to APERTA ("Service", "we", "us", or "our"). These Terms of Service (“Terms”) govern your access to and use of our software plugin, accessible through Atlassian Jira, and our associated website and services (collectively, the “Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

1. Eligibility

  • You must be at least 18 years old;
  • Legally capable of entering into a binding contract;
  • An authorized user of an Atlassian Jira instance.

2. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any manner that violates applicable laws or regulations;
  • Attempt to gain unauthorized access to any part of the Service;
  • Reverse engineer, decompile, or disassemble any part of the software;
  • Interfere with the Service's integrity or performance.

3. User Account and Jira Integration

The Service may require access to your Atlassian Jira account. By using the Service, you authorize us to connect to and interact with Jira’s APIs on your behalf.

You are responsible for:

  • Maintaining the confidentiality of any access credentials or tokens;
  • Ensuring that your use of the Service complies with Jira’s terms of use.

4. Data and Privacy

By using the Service, you agree to our Privacy Policy, which explains how we collect, process, and protect your data. You retain ownership of your Jira data. We act as a data processor when accessing or handling data through the Jira API.

5. Subscription and Payment

  • Access to certain features may require a paid subscription, billed through Atlassian Marketplace or directly through our site.

  • You may cancel your subscription at any time through your Atlassian account or by contacting us.

6. Intellectual Property

All content, software, and technology underlying the Service is owned or licensed by Tegrilu SRL. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Service Availability and Changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify or discontinue the Service at any time;
  • Introduce new features or impose limitations on existing ones;
  • Suspend or terminate access for violating these Terms.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms.

You may also terminate your use of the Service at any time.

Upon termination:

  • Your access to the Service is revoked;
  • Any locally stored data or caches may be deleted;
  • You remain liable for any charges incurred before termination.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

  • Indirect, incidental, special, or consequential damages;
  • Loss of data, revenue, or business opportunity;
  • Damages exceeding the fees paid by you for the Service in the 6 months preceding the claim.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Bucharest, Romania.

12. Modifications to Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above and provide reasonable notice, such as via email or a notice on the site.
